Terms & Conditions

 

THE BUYER AGREES TO BE GOVERNED BY THE FOLLOWING: 

 GENERAL

  • At Us Ice Machine Manufacturing Company, Inc. (“US Ice”) we strive to help our customers and welcome your suggestions.  We value our reputation and hope you will give us the opportunity to address any concerns you may have;  please feel free to call us at 305-681-0023 or toll free at 1.877.681.6623 with any questions or concerns.  If dialing from outside USA dials 1.877.429.6623.
  • For sales questions we can also be reached at 1-800-930-1997.

  • We reserve the right to modify these terms from time to time. It is the buyer's responsibility to review all terms and conditions before purchasing.
  • The buyer is responsible for obtaining all information necessary to make an educated decision regarding the purchase.
  • The buyer accepts responsibility for checking applicable state and local codes and for ensuring items meets those codes before purchasing.
  • All requests for non-standard services must be made in writing to US Ice.
  • The buyer will not hold US Ice responsible for anything not stated in the listing or included in the picture, including, but not limited to, assumptions made by the buyer or any verbal statements.

 

POINT OF SALE

  • All new equipment is sold FOB manufacturers' or US Ice’s dock in Miami, Florida.
  • All used equipment is sold FOB US Ice’s dock in Miami; FL. US Ice accepts no responsibility for items after they leave our dock.

 

SALES TAXES AND FEES

  • We are required by law to charge sales tax of 7% on all items delivered in Florida or picked up from our warehouse.
  • Most items are available for pick up at US Ice factory warehouse located at 650 NW 123rd Street Miami, Florida 33168.  Items picked up at US Ice will be charged 7% Florida sales tax, but will not be charged shipping and packing fees.
  • Note: Export items must be delivered to the Buyer’s Freight Forwarder in order to avoid being charged Florida Sales Tax.

 

METHODS OF PAYMENT – AMERICAN EXPRESS, DISCOVER, VISA, MASTERCARD, PAYPAL, CHECK, CASHIER'S CHECK, WIRE TRANSFER

  • The buyer is responsible for paying for the item and for all taxes and fees.
  • US Ice accepts PAYPAL but will only ship to a VERIFIED PAYPAL ADDRESS. All orders are on a prepaid basis. Payments will be processed immediately in full. 
  • Payment may also be made with American Express, Discover, MasterCard, and Visa.
  • Customers may enter credit card information with confidence via our secure server.
  • WE ACCEPT CREDIT CARDS DRAWN ONLY ON U.S. BANKS. (Some exceptions may be made for Canadian customers.  Please contact us for further details.)
  • We also accept cashier’s check only from reputable banks and are subject to clearance. For wire transfer please call us for wiring instructions.
  • For international customers please call US Ice to make arrangements via wire transfer.

 

CONDITION OF MERCHANDISE AND WARRANTIES

  • The seller agrees to present all items as accurately as possible based on the information available to us and on our knowledge at time of posting.  There is no guarantee regarding accuracy of this information.  There are NO WARRANTIES of either merchantability or fitness for a particular use. 
  • Any concerns about Merchandise will be limited to what is covered in the particular manufacturer's warranty. The buyer will hold US Ice harmless for all matters regarding the item, including, but not limited to, any matters regarding the manufacturer's performance per the warranty.
  • Merchandise must be assembled, installed, and adjusted by knowledgeable, licensed, authorized and experienced personnel.  Improper installations may cause malfunction and may void any warranty.
  • US Ice attempts to present items as accurately as possible based on the information available to US Ice at the time of sale. US Ice reserves the right to correct typographical errors and inaccuracies.

 

CUSTOMER PICK UP POLICY

  • All customer pick-ups are subject to 7% Florida sales tax. 
  • Within 15 days of online purchase all items must be picked up as soon as possible.  If the buyer does not arrange for pickup or delivery of items within 15 days from the date of online purchase then a storage charge of $30 or 10%, whichever is greater, per item will be charged which will purchase an additional 30 days of storage.  All items not picked up within 60 days from close of sale will be considered abandoned.  After 60 days items will be restocked for a fee equal to the purchase price of the items and resold.  Ownership of the item will return to the seller and all monies paid by the buyer related to these items will be forfeited.
  • Most items purchased are available for pick up at our Miami warehouse Monday through Friday from 8:30 AM to 5:00 PM Eastern Standard Time (please note that we are closed on some holidays). 
  • Our friendly warehouse staff will be happy to assist you with the loading of your vehicle.  (Please call to make sure the particular item is in stock at our warehouse.)
  • For orders exceeding 10 items, a three-business day notice is required.
  • IMPORTANT NOTE: SECURING OF THE LOAD IS THE SOLE RESPONSIBILITY OF THE CUSTOMER. US ICE ASSUMES NO LIABILITY OR RESPONSIBILITY FOR DAMAGES AS A RESULT OF LOADS BEING IMPROPERLY OR INADEQUATELY SECURED.
  • Note: Export items must be delivered to the Buyer’s Freight Forwarder in order to avoid being charged Florida Sales Tax.

 

RECEIPT OF ORDER AND DELIVERY

  • Orders are usually shipped about 5-15 business days after payment has been processed and the order confirmed, unless otherwise noted in the item's listing. However, due to occasional stock issues, orders may potentially take 4-6 weeks to ship. There is no guarantee of shipping times; however US Ice will try its best to get the items out to you as soon as possible.  If you have questions about the status of your order please contact us by phone or email.
  • NOTE:  Ice machines manufactured by US Ice are special order items that are usually not in stock and take about 3 - 6 weeks for completion.  Please call if you need the machine by a specific time period.
  • The buyer pays all costs relating to the shipment, including charges by the shipping company that were not paid during check out. These might include, but are not limited to: additional charges due to inaccurate information provided to US Ice relating to the delivery, charges due to failed delivery attempt(s) by the shipping company, etc.
  • The equipment is sold FOB manufacturers' dock at the facilities' location or FOB US Ice’s dock in Miami, Florida 33168.
  • Ownership of the goods passes to the buyer at the shipping point. The seller accepts no responsibility for the item once it is shipped. The buyer agrees to perform his fiduciary duty to protect his property after it is shipped.
  • Any refused shipments or items, as well as any shipments the carrier cannot deliver, will be considered delivered to and accepted by the buyer.
  • The buyer is responsible for inspecting the shipment during delivery by the shipping company for damages, both obvious and hidden. The buyer will accept the delivery and note on the delivery receipt any damages or concerns. Failure to notate any defects could result in a significant reduction in the carrier's liability during damage claims.
  • The buyer is responsible for filing any loss or damage claims in the manner and time frame directed by the carrier. Shipping companies do not allow third parties to file or get involved in a damage claim. US Ice is a third party in the shipment of most of the items it sells. It is the SOLE DUTY OF BUYER TO CONTACT THE SHIPPER IMMEDIATELY  for filing and handling of the claims based on the buyer's needs and requests.
  • The buyer is responsible for any concerns, issues, or charges for these shipments and agrees to hold US Ice, its suppliers, and its vendors harmless.


FOR ORDER CANCELLATION

  • Any request for cancellation must be made in writing to US Ice before the goods have shipped. This may be by posting a request in the buyer's message area on US Ice's web site, by sending an email from the email address registered with the seller, or by certified mail. Other types of communication (e.g., voice message, email from unverified address) may not be recognized.
  • If a cancellation request is not received in a sufficient time frame for the shipment to be held by the supplier, it will be considered a Request for Return. (See Returns & Refunds section below.)
  • If the supplier allows cancellations, the refund will be subject to a 5% cancellation fee. This fee will be waived in the following situations.
  • There was a problem caused by US Ice, its suppliers or its vendors, such as the item being discontinued or being on back-order.
  • The customer chooses to receive a store credit good for six months. (A refund of any balance of such a store credit will be subject to the 5% cancellation fee.)
  • If the supplier does not allow a cancellation (such as for a manufactured-to-order item), the cancellation request may be denied or may be subject to higher cancellation fees (usually a minimum of 25%).
  • The buyer agrees to abide by US Ice’s decisions regarding cancellation fees.
  • NOTE ALL SALES ARE FINAL FOR PRODUCTS MAUFACTURED BY US ICE MACHINE MANUFACTURING COMPANY.  US ICE MACHINES ARE CUSTOM MANUFACTURED TO ORDER!!!!!


REPORTING OF PROBLEMS

  • The buyer must notify US Ice of any refused shipments.
  • Problems or concerns must be reported within 3 days of receipt of the item.
  • Any reports of malfunction must include an inspection report from a knowledgeable, licensed, authorized, experienced technician detailing his findings regarding the issue.
  • The buyer agrees to abide by US Ice’s decisions regarding problem resolution.
  • Note:  US Ice is not in a position to replace the equipment without the Manufacturer’s Authorization.

 

RETURNS & REFUNDS

  • Any concerns must be submitted to US Ice by email, fax, or registered letter within 3 calendar days of receipt of items.
  • Not all items will qualify for returns. Approval of return requests is at the sole discretion of US Ice.
  • The buyer must obtain a Return Authorization number from US Ice prior to returning any items.  Shipments will be refused without RMA.
  • Refused and returned goods will be inspected to assess condition and re-salability.
  • New items returned must be new, unused, and contain all original parts, accessories, manuals, and shipping materials.
  • The buyer will be responsible for the following costs unless otherwise stated in writing by US Ice.
  • Original packing and shipping costs
  • Return shipping costs
  • Restocking fees
  • Repair charges for any damages incurred to product
  • Charges disclosed as non-refundable
  • If the seller agrees there is a misrepresentation, the seller will refund only the purchase price of the merchandise upon its return to the specified return address.
  • US Ice will deduct all applicable charges before issuing a refund.  If return costs and fees exceed the original charges, the buyer is responsible for the difference and authorizes US Ice to charge his credit card.
  • The buyer's account will be adjusted in the amount stated by US Ice once all procedures have been followed.
  • If the buyer fails to follow these terms and conditions, there will be no credit.
  • The buyer must recognize that complexity of returns and cancellations may cause a refund to take up to two billing cycles.  US Ice’s customer service and accounting staff will work hard to complete the process as quickly as possible.
  • NOTE ALL SALES ARE FINAL FOR PRODUCTS MAUFACTURED BY US ICE MACHINE MANUFACTURING COMPANY.   US ICE MACHINES ARE CUSTOM MANUFACTURED TO ORDER!!!!!

 

SHIPPING OPTIONS

  • Shipping is available only within the contiguous United States (excludes Alaska and Hawaii) and to Canada.
  • The Shipping calculator is only estimation. Shipping may be more or less due to actual weight, incorrect information, or mis-classification.
  • Shipments to Canada must be self-brokered, the buyer must make ALL shipping arrangements and inform US Ice of the details.
  • New items shipped from the factory are occasionally backordered.  The buyer should contact US Ice at (305) 681-0023 if a guaranteed ship date is needed.
  • New items are shipped with Manufacturer’s standard packing.  Additional protective packing (e.g., crating or box construction, wrapping, strapping to pallet) is usually available. The buyer must request this service in advance and cover the additional packing charges.
  • Only curbside delivery is offered. The seller does not offer or arrange for inside delivery.
  • Liftgate services are available for an additional fee. This service must be specified during checkout.
  • Residential delivery is available for an additional fee. This service must be specified during checkout.
  • Insurance on shipments is not a standard service. The buyer may call to discuss options and fees.
  • Signature services are not standard. The buyer may call to discuss options and fees. There is no expectation of a signed proof of delivery otherwise.
  • US Ice will arrange for shipping at the buyers request. US Ice accepts no responsibility of any kind for items damaged after they leave US Ice’s warehouse.
  • It is the buyer's responsibility to open the shipment and inspect items for concealed damage immediately upon receipt.
  • All freight received damaged must be documented on the bill of lading in the presence of the delivery driver.


SHIPPING OUTSIDE THE 48 CONTIGUOS UNITED STATES OF AMERICA / CARRIBEAN / CENTRAL & SOUTH AMERICA

  • Shipments outside of the 48 contiguous United States of America, Caribbean, Central and South America, must be self-brokered by the buyer or buyer can use their own broker.  Buyer must make ALL shipping arrangements and inform US Ice of the details.
